Terms of Use

These terms govern the use of the Gardenly mobile app, developed and operated by Mateo Lorenzo ("Gardenly" or "we"), based in the Province of Buenos Aires, Argentina. By installing or using the app you accept these terms. If you do not agree with them, do not use the app.
How we handle your data is described in the Privacy Policy, which forms part of these terms.
1. What Gardenly is
Gardenly helps you identify plants from a photo, estimate their health, build watering, fertilizing and treatment plans, and get care reminders. Results are produced by combining artificial intelligence models with a catalog of species and problems curated by us.
2. Results are guidance, not certainty
Species identification and diagnoses are automated estimates and can be wrong. Gardenly does not replace the judgement of a professional.
- Do not use the app to decide whether a plant is edible, medicinal or safe for people or animals.
- Before applying pesticides, fertilizers or treatments, read the manufacturer's instructions and your local regulations.
- If a plant matters to you, confirm the diagnosis with a nursery or a specialist.
We are not liable for damage to plants, people, animals or property arising from following the app's recommendations.
3. Your account
When you finish the welcome flow, an anonymous account is created on your device. You are responsible for keeping your phone and its access secure. If you delete the app without having linked an Apple or Google account, you lose access to your garden and we cannot recover it.
You can delete your data at any time from Settings, with the "Delete my data" option.
4. Free plan and full access
Free plan. You can identify or diagnose up to 3 new plants at no cost. Everything you do with those plants afterwards, such as health check-ups, care plans and reminders, stays free.
Full access. This is a subscription that removes the analysis limit. It comes in two forms:
- Yearly access, with a 7-day free trial for anyone who has never subscribed before. When the trial ends you are charged the yearly price, unless you cancel at least 24 hours beforehand.
- Monthly access, with no trial period.
The exact price in your currency is shown in the app and in the store before you confirm the purchase. Payment is made through your Apple App Store or Google Play account, depending on the device you subscribe from.
Renewal and cancellation. Subscriptions renew automatically for the same period until you cancel them. The renewal charge is made within the 24 hours before the end of the current period. You can cancel at any time from the subscriptions section of your Apple or Google Play account, or from "Manage subscription" inside the app. Cancelling stops future charges but does not refund the period already paid. Refunds, where applicable, are handled by Apple or Google under their own policies.
Changing plan. If you move from monthly to yearly, the change is immediate. If you move from yearly to monthly, the change applies when the current yearly period ends.
Restoring purchases. If you reinstall the app or change device using the same Apple or Google account, you can recover your subscription with "Restore" on the paywall or in Settings. Subscriptions do not transfer between the App Store and Google Play.
Purchases made on the App Store are also subject to Apple's standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
5. Your photos and content
The photos and notes you upload are yours. You give us permission to store them, process them and send them to the analysis providers described in the Privacy Policy for the sole purpose of providing you the service. We do not use your photos for advertising and we do not share them publicly.
You agree to upload only content you have the right to upload and that does not infringe third-party rights or the law.
6. Acceptable use
You may not use Gardenly for unlawful purposes, attempt to access other users' data, interfere with the operation of the service, scrape the catalog's content, or circumvent the limits of the free plan. We may suspend or close accounts that breach these terms.
7. Intellectual property
The app, its design, its catalog of species and problems, the texts and the illustrations are the property of Gardenly or are used under license. Some species photographs come from Wikimedia Commons and are shown with the attribution and license belonging to each author, as indicated in the app itself. We grant you a personal, limited and non-transferable license to use the app on your devices.
8. Availability and changes
We do our best to keep the service available, but we do not guarantee uninterrupted operation. We depend on external providers for image analysis, weather and payments, and their outages can affect the app. We may modify, add or withdraw features. If we withdraw a feature central to the subscription, we will tell you in advance.
9. Limitation of liability
To the extent permitted by law, Gardenly is not liable for indirect damages or for loss of data, plants or profits arising from the use of, or inability to use, the app. Nothing in these terms limits the rights granted to you by Argentina's Consumer Protection Act (Law 24.240) or other mandatory rules of public policy.
10. Termination
You can stop using Gardenly at any time by deleting the app and, if you wish, your data. We may terminate your access if you breach these terms. The clauses on intellectual property and limitation of liability survive termination.
11. Governing law
These terms are governed by the laws of the Argentine Republic. Any dispute is submitted to the competent ordinary courts of the Province of Buenos Aires, without prejudice to the rights that apply to you as a consumer.
12. Changes to these terms
We may update these terms. When a change is significant, we will tell you inside the app before it takes effect. Continuing to use the app after that notice means you accept the new version.
